1. Acceptance of Terms

Welcome to DomesticJobs. By accessing or using our platform, website, mobile application, or WhatsApp services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all users of the Service, including job seekers (domestic workers) and employers.

2. Description of Service

DomesticJobs is an online platform that connects domestic workers (including nannies, housekeepers, cooks, gardeners, drivers, and other household staff) with employers seeking their services in Zimbabwe. We provide:

• A platform for job seekers to create profiles and showcase their skills
• A platform for employers to post job listings and browse worker profiles
• Communication tools to facilitate connections between parties
• Identity verification services
• WhatsApp-based registration and communication

Important: DomesticJobs is a platform provider only. We do not employ domestic workers, nor do we act as an employment agency. Any employment relationship is solely between the job seeker and the employer.

3. User Accounts

3.1 Eligibility

You must be at least 18 years old and legally able to enter into contracts to use our Service. By registering, you represent that you meet these requirements.

3.2 Account Registration

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.3 Account Types

• Job Seeker Account: For individuals seeking domestic work opportunities
• Employer Account: For individuals or households seeking to hire domestic workers

4. User Conduct

You agree not to:

• Provide false or misleading information in your profile or communications
• Impersonate any person or entity
• Use the Service for any illegal or unauthorized purpose
• Harass, abuse, or harm other users
• Post discriminatory content based on race, gender, religion, or any protected characteristic
• Spam or send unsolicited messages to other users
• Attempt to gain unauthorized access to the Service or other user accounts
• Interfere with or disrupt the Service or servers
• Scrape, harvest, or collect user data without authorization
• Use the Service for human trafficking or any exploitative practices
• Post content that is defamatory, obscene, or offensive

5. Job Seeker Responsibilities

As a job seeker, you agree to:

• Provide accurate information about your skills, experience, and qualifications
• Submit genuine identification documents for verification
• Provide truthful references when requested
• Communicate honestly with potential employers
• Honor commitments made to employers
• Maintain professional conduct during interviews and employment
• Notify us of any changes to your availability or profile information

6. Employer Responsibilities

As an employer, you agree to:

• Provide accurate job descriptions and requirements
• Comply with all applicable labor laws and regulations in Zimbabwe
• Treat job seekers with respect and dignity
• Pay workers fairly and on time as agreed
• Provide safe working conditions
• Not engage in any form of discrimination or exploitation
• Honor employment agreements made with workers
• Report any issues or concerns to DomesticJobs

7. Verification Services

We offer identity verification services to help build trust on our platform. However:

• Verification confirms the identity submitted but does not guarantee character or work quality
• Employers should conduct their own due diligence before hiring
• We are not liable for any acts or omissions of verified users
• Background checks are limited to available public records

8. Fees and Payment

Basic use of DomesticJobs is free. We may offer premium features or services for a fee. Any applicable fees will be clearly disclosed before you commit to payment. All fees are non-refundable unless otherwise stated.

Any payment arrangements between employers and workers are solely between those parties. DomesticJobs does not handle wages or employment payments.

9. Content and Intellectual Property

9.1 Your Content

You retain ownership of content you post (profiles, photos, messages). By posting content, you grant DomesticJobs a non-exclusive, royalty-free license to use, display, and distribute your content on the platform.

9.2 Our Content

The DomesticJobs name, logo, website design, and all associated content are our intellectual property. You may not copy, modify, or distribute our content without written permission.

10. Disclaimers

DomesticJobs is not responsible for:

• The conduct, actions, or omissions of any user
• The accuracy of information provided by users
• Any disputes between employers and workers
• Employment outcomes or job performance
• Loss or damage arising from use of the Service

11. Limitation of Liability

To the maximum extent permitted by law, DomesticJobs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of or inability to use the Service.

12. Indemnification

You agree to indemnify and hold harmless DomesticJobs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. You may also delete your account at any time through your account settings or by contacting us.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will survive.

14. Dispute Resolution

Any disputes arising from these Terms or use of the Service shall be governed by the laws of Zimbabwe. We encourage users to contact us first to resolve any disputes amicably.

For disputes between employers and workers, DomesticJobs may offer mediation services but is not obligated to do so. Such disputes are ultimately between the parties involved.

15. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
